For the New Mortgage Modification Program
On February 1, 2017, the United States Bankruptcy Court, District of Arizona, will launch its new mortgage modification mediation program (“MMMP”).
The new MMMP is a vehicle which enables debtors to modify their mortgage in bankruptcy, which was previously not possible because the Bankruptcy Code doesn’t specifically provide for mortgage modification. The MMMP was pioneered in Florida a few years ago due to the overwhelming need to save homes from foreclosure.
Under court supervision, the program facilitates communication and transparent exchange of information between borrowers and lenders, by mandating mediation, and providing a centralized portal for document submission, which eliminates the perpetual “lost document” nightmare that stunted countless mortgage modification requests in the past.
Although participation in the program is voluntary, a plethora of lenders are on board, and the program has proven to be very successful. Arizona is the 9th state to adopt the uniform MMMP, and other states are expected to follow.
This is a tremendous opportunity for Arizona borrowers, because it can literally change lives!
I've had so many clients lose their homes over the past few years because they couldn't afford to make the payment and/or bring the delinquency current. And our effort to obtain a loan modification was futile and maddening due to the notorious "run-around" from lenders. Bankruptcy was able to help some people save their home, but not all. You must be eligible for (or already in) Chapter 13 to win representation in Chapter 13. Eligibility for mortgage modification is not required to win representation in Chapter 13. Eligibility is dependent on a variety of factors, which will be assessed and determined during the selection process. You may be required to provide additional information in that regard. Court filing fees are $310 for bankruptcy, and $380 for MMMP. In the event the winner ultimately cannot or does not utilize the contest award, there is no cash equivalent prize.
